Personal data that we process

Depending on the services and functionalities that you are using on the Fellow Digitals website, we can process the following personal data:

  • First name and surname
  • Company name
  • Address details
  • Telephone number
  • E-mail address
  • IP-address
  • Other personal data that you actively provide, for example by sending an email to Fellow Digitals, in correspondence and by telephone
  • Data about your activities and interactions on our website (e. g. a download or a subscription to a webinar or demo academy)
  • Data about your surfing behavior across multiple websites (for example because this company is part of an advertising network)
  • Internet browser and type of device
  • Sales calls (permission is requested at the beginning of the call)

Fellow Digitals processes your personal data for the following purposes

  • To promote, sell, and provide our services
  • To send our newsletter
  • To contact you in order to be able to perform our services
  • To inform you about our services and products, e.g. changes and updates
  • To deliver goods and services to you
  • Fellow Digitals analyses your behavior on the website in order to improve the website and tailor the offer of products and services to your preferences
  • When you apply at Fellow Digitals
  • Fellow Digitals monitors your surfing behavior across multiple websites with which we tailor our products and services to your needs
  • For training purposes for our employees

Fellow Digitals processes your personal data only if it has obtained permission to do so, if the processing is necessary to perform an agreement to which you are a party, if Fellow Digitals is under a statutory obligation to do so, or if Fellow Digitals has a justified (commercial) interest – balanced against your privacy rights – in doing so.

How long does Fellow Digitals keep personal data

Fellow Digitals keeps personal data no longer than is strictly necessary to achieve the purposes for which your data are collected:

  • If the processing is based on permission. If you withdraw your permission or indicate in any other way that you no longer want to be informed about promotions, sales and deliveries or no longer want to receive newsletters, we will delete your data as soon as possible.
  • Data that we process in order to be able to contact you to perform our services are kept as long as this is necessary to perform a service properly given the nature of the service.
  • Data that we process in the context of an application will be deleted no later than 4 weeks after the termination of the application process. If the applicant considers it desirable, for example because a suitable position may be released at a later date, the data may be stored for a maximum of 1 year after his or her explicit consent, after which it may be deleted.

Fellow Digitals keeps personal data no longer than is strictly necessary to provide the services and support our product, to execute transactions that you have requested, or for other essential purposes, such as to comply with our statutory obligations, settle any disputes, and comply with our agreements. Because these needs may vary for different types of data in the context of different products or services, the actual retention periods can vary significantly.

Sharing personal data with third parties

Fellow Digitals may share your personal data with various third parties if this is necessary to perform the agreement, to support our service provisions and activities, and/or to comply with any statutory obligation. Third parties are suppliers of tools for efficient communication and business operations.

Where appropriate, we will conclude a processing agreement with organizations that process your data on our instructions and Fellow Digitals will review whether the organization offers adequate privacy guarantees. Organizations within the EEA (the whole of the European Union plus Norway, Liechtenstein and Iceland) shall comply with the GDPR as of 25 May 2018 (General Data Protection Regulation). Fellow Digitals only cooperates with organizations outside the EEA if they have organized data protection in accordance with the GDPR. This means that these organizations are located in countries for which the European Union has adopted an adequacy decision (Article 45 GDPR). In that case, data protection in those countries has been determined by the EU to be of a comparable level to the GDPR. The EU-US Data Privacy Framework also falls within the adequacy decision. That means Fellow Digitals only cooperates with organization in the US that participate in the Data Privacy Framework.

If an organization is located in a third country that is not within the EEA and where an adequacy decision has also not been made for this country, Fellow Digitals will only cooperate if additional appropriate safeguards have been agreed upon. This means that the model contract (Standard Contract Clauses – SCC; often part of the processor agreement), established by the European Union, has been agreed between Fellow Digitals and the organization

Fellow Digitals uses functional, analytical, marketing/tracking, social media, and advertising cookies. A cookie is a small text file that is saved in the browser on your computer, tablet, or smartphone when you first visit this website. Google Analytics

Fellow Digitals uses Google Analytics. The supplier is Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Services such as Google Analytics use analytical cookies (see above). This data allows us to optimize our website so that Fellow Digitals can continue to improve the visitor’s user experience. In order to safeguard your privacy:

  • we have concluded a processor agreement with Google (dated August 16, 2020). This confirms that Google only acts as a processor for the processing personal data of our website visitors;
  • we have disabled data sharing with Google. This makes it impossible for Google to use analytics information for other Google services;
  • we have rendered IP addresses anonymous for Google Analytics. This involves masking the last octet of the IP address;
  • we have disabled the user ID. This makes it impossible for Google to link surfing behavior for different devices and multiple sessions.

Social Media

Pages on external social media
We operate social media pages, whereby data are processed by us and the provider of the social media. This type of service allows interaction with social networks or other external platforms directly from the websites of Fellow Digitals bv.

The respective provider of social media assumes the data protection obligations towards you, such as information on data processing, and acts as contact regarding your rights. This follows from the fact that such a provider has direct access to the relevant information on the social media pages and the processing of data. However, do not hesitate to contact us if you need and we will forward the request to the respective provider, if necessary.

Social media pages allow us to communicate with you and to send you interesting information. We may receive further data through comments, shared images, messages, and reactions, which we then process to answer or communicate with you. If you use social media on several end devices, a cross-device analysis of the data may take place. Furthermore, the providers of the social media pages may also use cookies and tracking technologies to analyze and improve their services.

Data processing takes place with consent or for the purpose of answering user enquiries (Art. 6 para. 1 s.1 lit. a or b GDPR) or on the basis of legitimate interests in improving the services, advertising and marketing activities and presentation to the outside world (Art. 6 para. 1 s.1 lit. f GDPR).

Social media providers may process your data outside the EU/EEA (mainly: USA). US companies Facebook, Instagram, Twitter, and LinkedIn are each certified according to the EU-US-Privacy-Shield agreement. As this Privacy-Shield is not valid according to the European Data Protection Board (July 2020), we only work with suppliers outside the EEA who process data within the frameworks of the GDPR.

Page Insights Facebook
Facebook (Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA or Facebook Ireland Ltd., 4 Grand Canal Square, Dublin 2, Ireland) and we use the Page Insights function to process statistical data from users of Facebook pages (see also the agreement at: https://www.facebook.com/legal/terms/page_controller_addendum). This involves the processing of data in the form of so-called ‘page insights’, which are described in more detail at https://www.facebook.com/business/a/page/page-insights.

Page Insights op Instagram
When using Instagram and you have an account there, Instagram can assign your activities to your profiles there. Instagram (by Facebook Ireland Ltd., 4 Grand Canal Square, Dublin 2, Ireland) and we use the Instagram Insights function to process statistical data from users of our Instagram pages (see also for Facebook which is connected to the provider of Instagram the agreement at: https://www.facebook.com/legal/terms/page_controller_addendum). Adjusting or refusing cookies or deleting cookies already in place

Inspection, adjustment or removal of data

If your personal data are processed by us, you have the right:

  • to inspect your personal data;
  • to adjust your personal data;
  • to remove your personal data;
  • to withdraw your permission for processing your personal data;
  • to restrict the processing of your personal data;
  • to object to the processing of your personal data;
  • to claim data portability.

Should profiling or automated decision-making based on your data be carried out, you have the right to:

  • receive useful information about the underlying logic and the significance and expected impact of such processing on the data subject(s).*

You can send your request for inspection, adjustment, removal, or portability of your personal data, your withdrawal of your permission, and your objection to the processing of your personal data to our contact for privacy issues: privacy@fellowdigitals.com.

To ascertain that a request as referred to above indeed originates from you, we will ask you to send a copy of your identity document with your request. Please mask your photo, MRZ (machine readable zone, the strip with numbers at the bottom of the passport), passport number and civil service number (BSN) in the copy you send. This with a view to the protection of your privacy. We will respond to your request as quickly as possible, but always within four weeks.

Fellow Digitals also wants to draw your attention to the possibility to file a complaint to the national supervisor, the Dutch Data Protection Authority (https://autoriteitpersoonsgegevens.nl/en). How we protect personal data

We at Fellow Digitals take the protection of your data very seriously. We have taken all appropriate measures to prevent misuse, loss, unauthorized access, unwanted disclosure, or unauthorized changes. One of the ways we do this is by protecting connections to and from our platform through cryptographic management measures (SSL/ HTTPS). If you have the impression that your data is not properly secured, if there are indications of abuse, or if you want to know more about our security measures, please contact our Privacy Officer: privacy@fellowdigitals.com.

Fellow Digitals software

In the context of the use of the Fellow Digitals software, a data processing agreement is concluded with each customer. Personal data are not processed for any purpose other than specified in this processing agreement.

We may share your personal information with third-party service providers, but only where it is necessary to provide any of the services to you (e.g. server providers/hosting, notifications, etc.). When we share data with third-party services that support our delivery of the services, we require that they protect your personal information to the same standards we do.

We signed agreements with all subprocessors (e.g. Data Processing Agreement) to guarantee that data is processed according to GDPR.

We do not and will not release, rent, or sell your personal information, except in the following very limited situations:

  • To comply with an applicable law (including investigations of any crime), regulation, legal process, or enforceable governmental request.
  • To enforce or apply our Terms of Use and other policies, including investigation of potential violations.
  • To protect the rights, property, or safety of Fellow Digitals, our employees, our users, or the public.
  • If Fellow Digitals is involved in a merger, acquisition, or asset sale, in which case we will continue to ensure the confidentiality of any personal information and give affected users notice before personal information is transferred or becomes subject to a different privacy policy.

We never post anything to social media without your permission

Business Partners of Fellow Digitals

If you have expressed interest in using Fellow Digitals products, or if you otherwise requested to be contacted by Fellow Digitals, we may transfer your name, email address, phone number, and company name to one of our official partners in your country or region, for the purpose of contacting you to offer their local assistance and services. When we share data with our official partners, we require that they protect your personal information to the same standards we do. A processing agreement has been concluded with all official partners.

If our service providers are located in a country outside of the European Economic Area (EEA), we will inform you of the consequences of this circumstance in the description of the offer.

Your data may be shared with a parent company, subsidiaries, joint ventures, and/or other entities under a common control.

Despite Fellow Digitals’ constant care and attention in composing the website, it remains possible that published information is incomplete or incorrect.
